At the 2017 Colloquium on International Law organized by the Asian Academy of International Law Ltd (AAIL) Adrian Lai presented his paper “Chinese State-Owned Enterprises and Jurisdictional Immunities.” In his presentation, Adrian referred the audience to the statement of the Chinese delegate made at a UN meeting, the statement of the Chinese Ministry of Foreign Affairs, the letter of the Chinese Government issued for the recent case of TNB Fuel Services Sdn Bhd v. China National Coal Group Corp. and the laws of the PRC in support of the proposition that that Chinese SOEs, which enjoyed autonomy in carrying on business operations, were separate and distinct from the State of the PRC, and accordingly were not entitled to assert sovereign or crown immunities that were afforded to Chinese Government.
Teresa Cheng SC, additionally spoke at the Colloquium in her capacity as Chair of the AAIL and Jose-Antonio Maurellet SC moderated the session.
Adrian’s paper will be published in the Proceedings of the Colloquium.
